$450,000 Total Settlement – Tibial Plateau Fracture from Distracted Driving Crash

Our client was riding as a front-seat passenger in a Ford Mustang when the driver became distracted while using a cell phone and rear-ended another vehicle at highway speed. The force of the impact violently thrust our client’s leg into the dashboard, causing a tibial plateau fracture—a serious knee injury requiring extensive medical care.

Injury & Treatment:
Following the crash, our client was diagnosed with a tibial plateau fracture and underwent orthopedic treatment, physical therapy, and pain management. Ongoing care was needed to restore mobility and reduce long-term impairment.

Insurance Dispute:
Despite the severity of the injury, AAA Insurance Company denied further Personal Injury Protection (PIP) benefits based on a one-time Independent Medical Examination (IME). We proved the IME doctor had no meaningful treatment history with the Plaintiff, conducted a limited review, and held a documented history of earning millions of dollars from insurance companies for opinions that routinely benefit insurers.

Our Legal Results:
We successfully challenged the biased IME findings with testimony and records from treating physicians who provided ongoing, hands-on care. As a result, we secured:

  • $250,000 in Bodily Injury Compensation
  • $200,000 in PIP Benefits (medical expenses, replacement services, attendant care, and more)

Total Recovery to Date: $450,000
