A night out should not end in violence at the hands of those hired to provide security. Our client was at a Detroit bar when he was falsely accused of misconduct by an employee. Instead of de-escalating the situation or calling law enforcement, a bouncer took matters into his own hands, violently assaulting our client and throwing him out of the establishment. The attack caused a serious closed head injury.
This was a clear case of excessive force and negligent security, which falls under premises liability law. Our investigation revealed that the bouncer acted without justification and that the bar had failed to properly train or supervise its staff on the lawful use of force. By taking on the role of judge and jury, the bouncer and his employer violated our client’s rights and were liable for the harm he suffered.
We built a powerful case demonstrating the bar’s failure to maintain a safe environment for its patrons. Faced with the evidence of their negligence, the bar’s general liability insurer agreed to a $750,000 settlement. This compensation covered our client’s medical expenses, lost wages, and the significant pain and suffering associated with the long-term effects of a traumatic brain injury.
