A 10-year-old boy’s childhood was forever changed while riding his bicycle on a residential sidewalk in Oakland County. A commercial van, approaching an intersection, struck the boy, inflicting catastrophic injuries including a mild traumatic brain injury (TBI), a broken left arm, and a broken left leg.
In an attempt to evade responsibility, the van driver falsely claimed the boy “darted out” into the street. Our firm conducted an exhaustive investigation to disprove this claim and expose the driver’s negligence. We demonstrated that the crash occurred in broad daylight with a wide-open field of vision. The driver had a clear, unobstructed view of the sidewalk and ample time to see the child. Furthermore, the police investigation found no skid marks, proving the distracted driver never even hit the brakes.
